1. Agreement
These terms are an agreement between you and [Legal entity name] (“InCorpDaily”, “we”, “us”), the operator of incorpdaily.in. By creating an account, subscribing or using the service, you agree to these terms, our Privacy Policy and our Refund & Cancellation Policy. If you use the service for a business, you confirm that you are authorised to accept these terms on its behalf.
2. An independent service
InCorpDaily is a private, independent service. We are not affiliated with, endorsed by, or acting on behalf of the Ministry of Corporate Affairs (MCA), any Registrar of Companies, or the Government of India. Our files and dashboard are not official records or certified copies. For official or legal purposes, verify information on the MCA’s own portal.
3. Where our data comes from
Company information becomes public when a company is incorporated in India: the Companies Act, 2013 requires it to be filed and made available for public inspection. We compile it into a convenient daily format.
- We source data only from publicly available records published through official government channels and from other lawful, publicly accessible sources.
- We do not obtain data by hacking, bypassing logins, CAPTCHAs or other access controls, misusing credentials, or buying, receiving or using leaked, stolen or unlawfully obtained data.
- We access sources in line with applicable law and the terms those sources set, and we do not overload or disrupt any government system.
- We do not invent or change the substance of records. We only clean and format them, for example removing stray characters, standardising dates and mobile numbers, and grouping activity codes into industries.
If you believe any information we hold was obtained or is being used improperly, write to support@incorpdaily.in and we will investigate promptly.
4. The service
- Daily files: each day’s newly incorporated companies, delivered by email and available in your dashboard for the most recent 7 days.
- Lead Finder: search, filter and export companies incorporated in the most recent 30 days.
- Daily files depend on when public records are published. A day with few or no incorporations, or a delay at the source, means a smaller or later file. That is not a failure of the service.
- We may improve or change features from time to time without reducing the core service you paid for.
5. Accounts
- You must be at least 18 years old and use the service for business purposes.
- Give accurate sign-up details and keep them up to date.
- One subscription is for one person’s login. Keep your password secure, and don’t share your account or files with people outside your subscription.
- You are responsible for activity on your account.
6. Plans and payment
- Email plan: ₹5,000 per month, with director names and email addresses. Email + Phone plan: ₹8,000 per month, which adds director mobile numbers. Prices are in Indian rupees. Applicable taxes, if any, are shown when you pay.
- There is no free trial. A plan starts once we have confirmed your payment.
- Plans do not renew automatically. Access ends at the end of the period you paid for, unless you pay for the next period.
- Refunds are covered by our Refund & Cancellation Policy.
- We may change prices for future periods. A change never affects a period you have already paid for.
7. How you may use the data
You may use the data for your own lawful business purposes, such as offering your services to new companies. You agree that you will:
- comply with India’s Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, and every other law that applies to how you contact people;
- follow TRAI’s telecom commercial-communication regulations, including the National Customer Preference Register (Do Not Disturb), before calling or messaging any mobile number;
- send only relevant, honest business communications. Identify yourself, and stop contacting anyone who asks you to;
- not sell, resell, rent, sublicense, publish or otherwise distribute the data, in whole or in substantial part, or use it to build a competing database or service;
- not use the data for spam, harassment, fraud, impersonation, discrimination, debt collection, credit or employment decisions, or any unlawful purpose;
- not scrape, crawl or bulk-download from our website or dashboard outside the export features we provide, and not try to get around the 7-day and 30-day limits or any other access control.
You, not InCorpDaily, are responsible for how you use the data and for any communication you send with it.
8. Intellectual property
Public facts belong to no one. Our compilation, formatting, industry classification, software, website and brand belong to [Legal entity name]. Your subscription gives you a limited, non-transferable licence to use the data and files for your own business while your plan is active and afterwards, subject to section 7.
9. Accuracy and disclaimers
We work to keep the data accurate, but we compile it from public records that may contain errors, omissions or outdated contact details. The service is provided “as is” and “as available”. We do not guarantee that any record is complete or correct, that any email or number reaches the intended person, or that you will win business from the data. As far as the law allows, we disclaim all implied warranties.
10. Limitation of liability
As far as the law allows, InCorpDaily is not liable for any indirect, incidental, special or consequential loss, or for lost profits, revenue, data or goodwill. Our total liability for any claim related to the service is limited to the amount you paid us for the month in which the claim arose.
11. Indemnity
You agree to compensate InCorpDaily for claims, penalties and costs, including reasonable legal fees, that arise from your breach of these terms or your use of the data, including any communication you send to people listed in it.
12. Suspension and termination
We may suspend or end your access, without a refund, if you breach these terms, misuse the data, or if the law or a lawful order requires it. You can stop using the service at any time by not renewing. Sections 7 to 11 and 14 continue to apply after your access ends.
13. Changes to these terms
We may update these terms. When we do, we change the effective date above, and for significant changes we will tell subscribers by email. If you keep using the service after an update, you accept the updated terms.
14. Governing law and disputes
These terms are governed by the laws of India. We will first try to resolve any dispute through good-faith discussion. If that fails, the courts at [City], India have exclusive jurisdiction.
